Abstract: During Qing Dynasty, the Chinese and foreigners lived together in Macau. With the increasing frequency in non-governmental exchanges, more civil disputes generated. Therein, the property leasing disputes occurred between Chinese and Portuguese were in the spotlight because of their special social reasons and causes of action. When judging such disputes, the local officers’ primary orientation was to maintain social stability. However, the thing behind the policy of stability maintenance was the governor’s deep-rooted defensive idea against non-Chinese, the dualistic system of Macau social administration and civil jurisdiction that based on the above defensive idea. The latter not only had negative impact on the settlement of civil disputes between Chinese and Portuguese but also further weakened Qing government’s judicial authority.
